{"id":4710,"date":"2024-01-16T15:05:32","date_gmt":"2024-01-16T14:05:32","guid":{"rendered":"https:\/\/www.corporatehealthservices.ch\/?post_type=service&#038;p=4710"},"modified":"2026-02-16T10:55:36","modified_gmt":"2026-02-16T09:55:36","slug":"trusted-person-in-the-company","status":"publish","type":"service","link":"https:\/\/www.corporatehealthservices.ch\/en\/service\/trusted-person-in-the-company\/","title":{"rendered":"Trusted Office Mentor"},"content":{"rendered":"\n<p>No matter the size of the company, the employer has a responsibility to ensure the protection of the physical and mental health of workers at the workplace.<\/p>\n\n\n\n<div style=\"height:0px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Legal framework<\/h2>\n\n\n\n<p>According to art.2 al.1 of the <a href=\"https:\/\/www.seco.admin.ch\/seco\/fr\/home\/Arbeit\/Arbeitsbedingungen\/Arbeitsgesetz-und-Verordnungen\/Wegleitungen\/wegleitung-zur-argv-3.html#-1755811567\" target=\"_blank\" rel=\"noopener\" title=\"\">Ordonnance 3 relative \u00e0 la loi sur le travail<\/a> (OLT 3), \u00ab the employer is required to give all necessary instructions and take all necessary measures in order to ensure and improve the protection of physical and mental health\u00bb.<\/p>\n\n\n\n<p>OLT 3 is quickly the subject of comments from SECO, which proposes five measures that every Swiss company should implement, including the designation of a<strong> Trusted Person in the company (PCE)<\/strong>, internal or external, to which the persons concerned can turn in case of conflict for advice and support in finding a solution to the problem.<\/p>\n\n\n\n<p>On 9 May 2012, a decision of the Federal Court gave force of law to these comments and invited companies to appoint a trustworthy person in order to prevent internal conflicts and help protect workers&#8217; health, particularly mental health.<\/p>\n\n\n\n<div style=\"height:0px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">An expanded field of activity<\/h2>\n\n\n\n<p>When we mention \u00ab PCE \u00bb, the first words that come to mind are: mobbing and harassment. However, its scope is broader and has evolved towards the prevention and treatment of all psychosocial risks, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Discrimination<\/li>\n\n\n\n<li>Feeling of surveillance<\/li>\n\n\n\n<li>Stress<\/li>\n\n\n\n<li>Burn out<\/li>\n\n\n\n<li>Harassment (psychological\/sexual)<\/li>\n\n\n\n<li>Offences against personal integrity<\/li>\n\n\n\n<li>Substance use<\/li>\n\n\n\n<li>Conflicts<\/li>\n<\/ul>\n\n\n\n<div style=\"height:0px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Role of the PCE<\/h2>\n\n\n\n<p>The Trusted Person in the Company provides a telephone hotline for all employees of a company.
